Terms & Conditions
The following terms and conditions apply specifically to the purchase of personal body armor, including, without limitation, soft armor, hard armor, armor plates, and helmets (collectively "Body Armor"), from thezendefense.com
ThezenDefense.com, in its sole discretion, reserves the right to refuse the sale of body armor to anyone for any reason. By purchasing body armor from ThezenDefense.com, you expressly certify and agree that:
- You are solely responsible for ensuring that your purchase of body armor complies with all applicable local, state, and federal laws associated with the purchase and possession of body armor.
- You are not legally prohibited from purchasing, possessing, or using Body Armor;
- You are not a felon;
- You are an adult at least 18 years of age;
- You are legally allowed to purchase, possess, and use body armor;
- Your purchase of body armor does not violate any local, state, or federal laws;
- You will only use body armor for lawful purposes and in compliance with all applicable laws, regulations, and ordinances;
- You are not purchasing body armor for criminal purposes;
- You are purchasing body armor for your personal use and not for resale, export, or use by someone else to avoid compliance with applicable laws or these terms and conditions.
Restrictions
ThezenDefense.com cannot lawfully ship body armor to customers outside the contiguous United States or to APO/FPO/DPO without State Department approval.
ThezenDefense.com cannot lawfully sell Body Armor to customers in Connecticut and New York, with some exceptions for law enforcement personnel and armed forces members.
Exclusions of warranty
ThezenDefense.com does not manufacture or control the manufacture of body armor sold by ThezenDefense.com online or in-store. The availability of body armor through ThezenDefense.com does not indicate an affiliation with or endorsement of any product or manufacturer. Accordingly, ThezenDefense.com does not provide any warranties with respect to the body armor that it sells. For warranty information, please contact the manufacturer directly.
ThezenDefense.com sells all body armor "as-is" and without warranty. ThezenDefense.com hereby expressly excludes and disclaims all warranties with respect to body armor, whether express or implied by law, course of dealing, course of performance, usage of trade or otherwise, including, without limitation, warranty of merchantability, warranty of fitness for a particular purpose, warranty of title, or warranty against infringement of intellectual property rights of a third party. Check with your jurisdiction to determine if the above disclaimer applies to you.
By purchasing body armor from ThezenDefense.com, you agree that ThezenDefense.com shall not be liable under any circumstances for any breach of warranty claims or for any damages arising from the manufacturer's failure to honor any warranty obligations that it may have to you.
Assumption of Risk and Limitation of Liability
You assume all risk and liability for your purchase, ownership, and use of body armor, regardless of any oral or written statements communicated by ThezenDefense.com, by way of technical advice or otherwise, related to the condition and use of the body armor.
In no event shall ThezenDefense.com be liable to you or any third party for consequential, incidental, special, exemplary, punitive, or enhanced damages, or lost profits or revenues arising out of or relating to any alleged breach of these terms and conditions, regardless of whether such damages were foreseeable, whether or not ThezenDefense.com was advised of the possibility of such damages, or the legal or equitable theory upon which the claim is based (tort, contract, or otherwise).
ThezenDefense.com sole and entire maximum liability and your sole and exclusive remedy shall be limited to the amount you paid for the body armor you purchased from ThezenDefense.com
This limitation of liability shall only apply to the extent permitted by law and shall not apply to liability resulting from ThezenDefense.com gross negligence or willful misconduct.
